1. AGREEMENT OVERVIEW

This Agreement applies to all persons entering or staying at Ten Acre Park (“the Property”), including visitors, riders, and overnight guests.

By entering the Property:

• You agree to all terms outlined in this Agreement

• You accept full responsibility for yourself, your guests, your horse(s), and your property

• You agree to follow all rules and instructions at all times

2. ASSUMPTION OF RISK

You acknowledge that equestrian activities are inherently dangerous and may result in serious injury, death, or property damage.

By entering the Property, you voluntarily accept all risks associated with:

• Riding and handling horses

• Being in close proximity to horses

• Use of facilities and equipment

• Staying overnight on the Property

3. LIABILITY WAIVER

To the fullest extent permitted by law, Ten Acre Park, its owner, and representatives accept no liability for any injury, loss, damage, or death.

This includes (but is not limited to):

• Riders, visitors, guests, and spectators

• Horses and animals

• Vehicles, floats, and equipment

• Accommodation and personal belongings

4. GENERAL CONDUCT

All visitors must:

• Act in a safe and respectful manner

• Follow all instructions from Ten Acre Park

• Not engage in reckless or unsafe behaviour

• Supervise children at all times

Ten Acre Park reserves the right to remove any person/ horse from the Property.

5. PROPERTY & FACILITY USE

Visitors agree to:

• Respect all facilities, equipment, and grounds

• Treat all fences as live

• Leave all gates as found and securely closed

• Not enter any restricted areas, including paddocks, sheds, yards, or private areas, without permission

• Not approach or handle any horse without the owner’s permission

6. RIDER & HORSE RESPONSIBILITIES

• Helmets must be worn at all times while mounted; the helmet must be compliant with NZ Safety Standards.

• Appropriate footwear and attire must be worn

• Horses must be under control at all times

• Clean up after themselves and their horse at all times

• Remove manure, hay, and rubbish and dispose of it in designated areas

• Leave all areas in a clean and tidy condition after use

Horses must be securely tied or stabled in designated areas.

7. DAMAGE & FINANCIAL RESPONSIBILITY

You agree that:

• You are fully responsible for any damage caused by you, your horse, or any person under your supervision

• Any damage to property, facilities, fences, or equipment must be reported immediately

• You will be financially liable for all repair or replacement costs

You agree to indemnify Ten Acre Park against any claims, losses, or costs arising from your actions.

8. VEHICLES & OVERNIGHT STAYS

Where applicable:

• Vehicles, trucks, and floats must be parked in designated areas only

• Power access must be used responsibly (if applicable)

• Guests must be considerate of others, including noise levels

All overnight stays and facility use must be pre-approved.

9. HEALTH, SAFETY & COMPLIANCE

• All hazards, damage, or unsafe conditions must be reported immediately

• Walkways, gates, and access areas must be kept clear

• Only designated areas may be used at all times
